FURNISH-ONLY DOOR AND FRAME LIMITED WARRANTY
Limited Two-Year Warranty (Workmanship and Material): DoorWall Systems Corporation (Manufacturer), White Plains, New York, warrants to the original purchaser that this furnish-only door will be free of manufacturer’s defects in workmanship and material. Should any manufacturer’s defect in workmanship or material appear within TWO (2) YEARS of the original date of shipment, Manufacturer shall correct such non-conformity, at its option, by repairing or replacing any defective part(s). This limited warranty is subject to the additional terms, exclusions, and limitations set forth below.
Limited Five-Year Warranty (Rust): Manufacturer further warrants the door frame against rust in non-damaged condition for a period of FIVE (5) YEARS from original purchase. This warranty does not apply to scratched, dented, damaged, or corroded areas of the frame. This limited warranty is subject to the additional terms, exclusions, and limitations set forth below.
Warranty Claims: Warranty claims must be made in writing as soon as reasonably possible, but in no event more than THIRTY (30) DAYS after the end of the applicable warranty period. All claims must include proof of purchase and installation date(s). For claims of defective workmanship or material, purchaser must complete the Defective Part Claim Form, available from Manufacturer, and furnish photographs of the allegedly defective part(s). Manufacturer reserves the right to require defective components be returned at purchaser’s sole expense.
Limitations and Exclusions: This warranty does not extend to normal wear and tear, damage beyond the Manufacturer’s control, or damage due to negligence, improper use, or installation not in accordance with Manufacturer’s instructions.
This warranty shall be void if: (a) installation or repair work is performed by anyone other than a DoorWall Systems Corporation Authorized Representative; (b) installation or repair work utilizes parts or methods not specified or approved by Manufacturer; or (c) installation or repair work alters the product or deviates from the original project plans and specifications without prior written change order approved by Manufacturer.
This warranty shall be void if the purchaser: (a) fails to comply with DASMA published voluntary Best Practices and Guidelines standards; or (b) fails to ensure compliance with all applicable codes and safety regulations, including appropriate placement of safety labels and tags at time of installation.
This is a limited warranty for replacement or repair of defective product workmanshiP or material. This warranty does not, under any circumstances, include any costs attributable or associated with any labor to perform warranty work or any costs to other trades that may have been affected due to a defect in product workmanship or material.
This warranty is the sole and exclusive warranty given by Manufacturer. Manufacturer makes and purchaser receives no other warranties of any kind, either express or implied. All warranties of merchantability and fitness for a particular purpose are expressly disclaimed and excluded.
In no event shall Manufacturer be liable or responsible to purchaser for any special, indirect, incidental, consequential, punitive, or other similar damages, including, but not limited to damages for delay, lost profits, lost sales, injury to person or property, or damage to a structure or its contents, arising under any theory of law or equity.
Additional Terms and Conditions: This warranty is contingent upon Manufacturer’s receipt of payment, in full, for all products, labor, and services provided on this project. Failure to receive payment will render this warranty null and void.
To the extent that any claims, losses, injuries, or damages result from any product defect or from the installation, use, or misuse of the product are covered by any insurance policy of the purchaser, the purchaser hereby waives all rights of itself and all rights of any insurer or other person claiming though it against Manufacturer with respect to any such claims, losses, injuries, or damages.
Any dispute, claim, or controversy arising out of or relating to this warranty or any warranty claim, including disputes over questions of arbitrability, shall be resolved by arbitration in Rhode Island in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association.
